1. Introduction and Acceptance
Bring is a platform operated by Delivre Ltd ("Delivre", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Bring mobile applications, websites, content, products, and related services (collectively, the "Platform" or "Services").
By accessing or using the Bring platform, whether as a passenger, sender, driver, or courier (collectively, "Users"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede any prior agreements or arrangements with you.
2. The Platform as an Intermediary
It is critically important to understand the nature of our business:
Bring is a technology platform, not a transportation or logistics carrier.
We provide a digital marketplace that connects individuals seeking transportation or delivery services with independent third-party contractors willing to provide those services.
Delivre Ltd does not provide transportation services, courier services, or function as a transport carrier. All such services are provided by independent third-party contractors ("Drivers" or "Couriers") who are not employed by Delivre Ltd or any of its affiliates. You acknowledge that Delivre has no responsibility or liability for any transportation or logistics services provided to you by third parties, other than as expressly set forth in these Terms.
3. User Accounts and Eligibility
- Age Requirement You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account. Unaccompanied minors are strictly prohibited from using the ridehailing services.
- Account Accuracy You agree to maintain accurate, complete, and up-to-date information in your Account. Failure to maintain accurate information, including having an invalid or expired payment method(where applicable) on file, may result in your inability to access the Services or the termination of this agreement.
- Account Security You are responsible for all activity that occurs under your Account. You agree to maintain the security and secrecy of your Account username and password at all times. You may only possess one Account unless otherwise permitted by Delivre in writing.

4. Rules for Riders and Senders
Ridehailing Rules
Riders agree to treat Drivers and their vehicles with respect. You may not carry open containers of alcohol, use illegal drugs, or transport dangerous weapons during a ride. You are responsible for the cost of repair for damage to, or necessary cleaning of, a Driver's vehicle resulting from your use of the Services.
Delivery and Courier Rules
When using Bring to send packages, you guarantee that you are the legal owner of the items or have lawful permission to transport them. You strictly agree NOT to send any of the following items:
- Illegal items, stolen goods, narcotics, or non-prescription drugs.
- Firearms, weapons, ammunition, or explosive materials.
- Hazardous, toxic, flammable, or radioactive materials.
- Live animals or human remains.
- Large amounts of physical cash, bullion, or highly valuable unsecured jewelry.
- Items that exceed the weight or size limits specified in the app for the selected vehicle type.
Delivre and its Couriers reserve the right to refuse, cancel, or safely dispose of any delivery request that violates these rules or is deemed unsafe, without refund.
5. Rules for Drivers and Couriers
As an independent contractor providing services on the Bring platform, maintaining a safe, reliable, and high-quality experience is essential. Drivers and Couriers agree to strictly adhere to the following rules:
- Account Ownership and Sharing: Account sharing is strictly prohibited. You may not allow any other individual to use your account to accept rides or deliveries. You must also only use the specific vehicle that has been inspected and approved on your profile.
- Compliance with Laws: You must obey all local traffic laws, speed limits, parking regulations, and transport licensing requirements at all times while logged into the platform.
- Zero Tolerance Policy: You must not consume or be under the influence of alcohol, illegal drugs, or impairing medications while logged into the app or providing services. Violation of this rule results in immediate and permanent account deactivation.
- Vehicle Maintenance and Safety: You are responsible for maintaining your approved vehicle in a safe, clean, and roadworthy condition, ensuring all seatbelts, brakes, and lights are fully functional.
- Package Integrity: When acting as a courier, you must transport items securely to prevent damage. You are strictly prohibited from opening, tampering with, looking through, or consuming any part of a delivery package.
- Professionalism and Non-Discrimination: You must treat all passengers, senders, and recipients with respect. Harassment, discrimination based on race, gender, religion, or orientation, or abusive behavior of any kind is strictly prohibited.
- Off-Platform Solicitations: You may not use the Bring platform to solicit users for cash rides or private delivery arrangements outside of the app. All trips initiated through the app must be completed through the app.
Delivre reserves the right to suspend or permanently terminate your access to the platform if you are found to be in violation of any of these rules.
6. Independent Contractor Status (Drivers & Couriers)
If you use the platform as a Driver or Courier, you acknowledge and agree that you provide services as an independent contractor, not as an employee, agent, or partner of Delivre Ltd. You maintain complete discretion over:
- When, where, and for how long you log into the Platform.
- Whether to accept, decline, or ignore any specific trip or delivery request.
- The route you take to complete a trip or delivery (provided it is reasonable and safe).
- The equipment and vehicle you use, subject to base platform safety and regulatory standards.
You are solely responsible for all tax liabilities, fuel, vehicle maintenance, insurance (including commercial or rideshare insurance if required by law), and operating costs associated with your use of the Platform.
7. Payments, Fares, and Billing
Charges
You understand that use of the Services will result in charges to you for the services or goods you receive from a Third Party Provider ("Charges"). Charges will be inclusive of applicable taxes where required by law. All Charges paid by you are final and non-refundable, unless otherwise determined by Delivre.
Dynamic Pricing (Surge)
You acknowledge that the amount of Charges may vary based on geographical area, time of day, traffic conditions, and overall platform demand. During times of high demand, fares and delivery fees may increase substantially ("Surge Pricing"). The app will always display the estimated fare or the applicable pricing multiplier before you confirm your request.
Cancellation Fees
If you cancel a ride or delivery request after a Driver has been allocated and is en route, or if the Driver cancels because you fail to appear at the pickup location within the allotted time, you may be charged a Cancellation Fee to compensate the Driver for their time and fuel.
Tips
Any tips or gratuities are entirely voluntary. 100% of the tip amount paid through the platform goes directly to the Driver or Courier.
8. Promotions and Referrals
Delivre may, in its sole discretion, create promotional codes that may be redeemed for Account credit, discounts, or other features. You agree that Promo Codes:
- Must be used for the intended audience and purpose, and in a lawful manner.
- May not be duplicated, sold, transferred, or made available to the general public unless expressly permitted.
- May be disabled by Delivre at any time for any reason without liability.
- Are not valid for cash and may expire prior to your use.
9. Intellectual Property
Subject to your compliance with these Terms, Delivre grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to access and use the Applications on your personal device solely in connection with your use of the Services. The Bring platform, its logo, design, algorithms, and content remain the exclusive property of Delivre Ltd and its licensors.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DELIVRE DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Furthermore, Delivre makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the Services, or that the Services will be UNINTERRUPTED, TIMELY, SECURE, RELIABLE, ACCURATE, OR ERROR-FREE. Delivre does not guarantee the quality, suitability, safety, conduct, or performance of ANY THIRD-PARTY DRIVER, VEHICLE, OR OTHER THIRD-PARTY SERVICE PROVIDER.
Where the Services facilitate transportation provided by independent third-party drivers or transportation providers, Delivre does not itself control every aspect of the transportation service, including the manner in which a driver operates a vehicle or performs a ride. You acknowledge that transportation involves inherent risks and that you are responsible for exercising reasonable judgment when using the Services.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ASSUME THE RISKS ASSOCIATED WITH YOUR USE OF THE SERVICES AND ANY TRANSPORTATION SERVICES ARRANGED THROUGH THE SERVICES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY, WARRANTY, OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DELIVRE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DELIVRE SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR LIABILITIES ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICES, OR FROM ANY TRANSACTION, RIDE, OR OTHER RELATIONSHIP BETWEEN YOU AND ANY THIRD-PARTY DRIVER OR SERVICE PROVIDER, EXCEPT TO THE EXTENT SUCH LIABILITY ARISES FROM DELIVRE'S OWN ACTS, OMISSIONS, OR BREACH OF THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DELIVRE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO DELIVRE FOR THE SERVICES DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE LIMITATIONS SET OUT IN THIS SECTION SHALL NOT APPLY TO THE EXTENT THAT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW, INCLUDING LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
12. Indemnification
You agree to indemnify and hold Delivre and its officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with:
- Your use of the Services or services or goods obtained through your use of the Services.
- Your breach or violation of any of these Terms.
- Delivre's use of your User Content.
- Your violation of the rights of any third party, including Third-Party Providers.
13. Account Suspension and Termination
Delivre reserves the right to immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason. Common reasons for account suspension include, but are not limited to: severe or repeated safety violations, payment fraud, physical or verbal abuse of drivers/riders, or carrying prohibited delivery items.
14. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute, conflict, claim, or controversy arising out of or broadly in connection with or relating to the Services or these Terms shall be first submitted to mediation under the auspices of the Nairobi Centre for International Arbitration (NCIA). If the dispute cannot be settled by mediation within 30 days, it shall be finally resolved by binding arbitration in Nairobi, Kenya, in accordance with the NCIA Arbitration Rules.
15. Changes to Terms
We may amend these Terms from time to time. Amendments will be effective upon Delivre's posting of such updated Terms at this location. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.
